Kara śmierci : podstawowe problemy i dylematy

Abstract

Wycofanie kary śmierci z katalogu kar w większości państw całego świata stanowiło niesłychanie długi i skomplikowany proces. Chociaż niektórym krajom, w szczególności Zachodu, kwestia ta przychodziła stosunkowo łatwo i płynnie, kraje spod „Żelaznej kurtyny” musiały zmagać się z walką o wolność, a jednocześnie zadbać o najwyższe i najcenniejsze dobro, jakim jest Życie człowieka. Historia kary śmierci w ujęciu myśli filozoficznej i historycznej jest tematem, który od zawsze nurtował najpotężniejszy umysły świata. A kwestia jej zniesienia, jak kiedyś, tak i dzisiaj wzbudza ogromne emocje i wywołuje wiele kontrowersji. Bez bliższej znajomości tematu nie jesteśmy w stanie opowiedzieć się za, bądź przeciw. Niniejsza praca jest wyrazem podjęcia próby wnikliwej analizy filozoficzno- historycznej zagadnienia. Co prawda nie przynosi rozwiązania problemu, jednakże przybliża do bardziej krytycznego myślenia, dzięki czemu każdy czytelnik będzie mógł odnaleźć swoje zdanie.

In most countries of the entire world abolition of the death penalty was a long and extremely complex process. While in some states, especially the Western ones, the removing the capital punishment from their Penal Codes went easier and more smoothly, the states from behind the “iron curtain” had to struggle for freedom, and at the same time to take care of the greatest good ever - human life. The philosophical and moral perspective of the history of the death penalty had always stimulated the greatest minds throughout. Whereas the matter of abolition has been rising an extremely emotional discussion and as much controversy until this day. Profound knowledge on the issue is needed to take part in the debate on canceling or preservation of the death penalty. This dissertation is an attempt to perform an insightful philosophical and historical analysis of the issue. Even though it does not solve the problem, it definitely brings us closer to more critical thinking, thanks to what a reader will be able to form their own opinion.
